Gerk Games ("we," "our," or "us") respects the intellectual property rights of others and expects our users to do the same. This page explains our position on copyright and how to submit a copyright concern.
1. Our Content Is Original
Every game published on gerkgame.com is an original work created by the Gerk Games team. We write each game from scratch in vanilla JavaScript using the HTML5 Canvas and standard web APIs. We do not embed third-party game portals, we do not host games from external networks, and we do not republish games made by others.
The same applies to our written content. All articles in our blog, all game descriptions, and all artwork and illustrations on this site are produced in-house by our team.
2. Why We Take This Seriously
Building original games is the entire premise of this site. We do this both because we enjoy it and because it lets us stand behind everything we publish. If you ever see content here that you believe infringes someone's copyright, we want to know — and we will act on it.
3. Reporting a Copyright Concern
If you believe that content on Gerk Games infringes a copyright you own or control, please send a notice to [email protected] with the subject line "Copyright Notice." Under the U.S. Digital Millennium Copyright Act (DMCA), a complete notice should include:
- Your physical or electronic signature.
- Identification of the copyrighted work you claim has been infringed.
- The exact URL on gerkgame.com where the allegedly infringing material is located.
- Your name, address, telephone number, and email address.
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
4. Our Response
We review every copyright notice we receive. When a notice is complete and valid, we will remove or disable access to the material in question promptly, typically within a few business days, and we will let you know what action we took.
5. Counter-Notice
If you believe content of yours was removed in error, you may submit a counter-notice to the same address. Please include identification of the removed material, its former location, your contact details, and a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake.
6. Repeat Infringers
Because we create all of our own content, there are no user uploads on this site. Should that ever change, we will adopt and enforce a policy of terminating access for repeat infringers in appropriate circumstances.
